Domain Name disputes occur between parties, including former business partners, competitors, and thieves or “pirates.”  Domain name disputes often include additional intellectual property issues, such as infringement on trademark rights.

The Internet Corporation for Assigned Names and Numbers (ICANN) operates the Domain Name System and defines policies for how the “names and numbers” of the Internet work. ICANN has adopted a Uniform Domain Name Dispute Resolution Policy (UDRP), which generally governs complaints about the registration or phrasing of a domain name.

A  trademark owner seeking to enforce its rights concerning an abusive registration of domain names (e.g. cybersquatting) can file a complaint in a court of proper jurisdiction or submit a complaint to an approved dispute resolution provider.  Legal strategies concerning domain disputes and trademark issues depend on the facts of each case.
